Product warrantyAll hardware purchased by reseller from e-DATA Corp shall be warranted fully by e-DATA for a period of two (2) years from e-DATA's invoice date against (A) any defects in manufacturing or design, or (B) any failure of the product to conform to the product sample provided to reseller by e-DATA. In addition to the preceding warranty to be provided by e-DATA, reseller shall have any and all rights and benefits of any manufacturer’s warranty (other than e-DATA). Except as required otherwise by law, this warranty shall be limited to the free prompt repair or replacement of any defective hardware or sub-assemblies, and is made on condition that e-DATA shall have the right to examine and determine whether any alleged defect was caused by reason of abnormal use, abuse, unapproved modification, incorrect servicing or gross negligence following its original shipment by e-DATA, in which case, the e-DATA warranty shall not be applicable. All cost of warranty repair or replacement and the shipment back to and from e-DATA via standard ground delivery, shall be borne by e-DATA. Except as required by law, this warranty is in lieu of all other warranties of merchantability, fitness, performance or otherwise, express or implied, statutory or by operation of law. Reseller shall make no warranty, guaranty or representation, whether written or oral, on e-DATA's behalf to any end-user purchaser of the product. Product returns e-DATA Corp shall offer repair service for product not covered by e-DATA’s warranty. Prior to shipping any product to e-DATA for a repair, reseller shall first obtain from e-DATA a Return Material Authorization (RMA) number, and then ship all product requiring repair to e-DATA's repair facility. All unwarranted repair shipments must be accompanied by a Purchase Order authorizing the repair and shall be identified by the RMA number assigned by e-DATA.
e-DATA will return the shipment to the shipper unless the shipper is outside the United States, in which event e-DATA will return the shipment to reseller or resller's designated representative in the United States, with notification to reseller that the repair has been completed, along with an invoice describing the repair and setting forth the cost thereof. Should non-warranty repair costs for any RMA exceed thirty percent (30%) of the product’s pricing, e-DATA will notify reseller and obtain reseller’s authorization before proceeding with the repair. The cost of non-warranty repair and shipment each way shall be borne by reseller.
